New York allows both fault-based and no-fault grounds for divorce. No-fault divorce is based on the grounds of an "irretrievable breakdown of the marriage" for a period of at least six months. Other fault-based grounds include cruelty, abandonment, imprisonment, adultery, or living separate and apart pursuant to a separation judgment or decree.
